Consular Assistance to Kenyans in Distress

The Embassy will strive to link Kenyans in distress with family members or acquaintances in Kenya or elsewhere to enable them to seek the assistance required.

Consular Services in cases of arrest and/or detention of Kenyan nationals in the Cuba

Apart from its diplomatic functions, the Embassy provides consular services to visiting, transiting or resident Kenyan nationals. Consular functions are provided for in the Vienna Convention on Consular Relations, 1963.

As provided in the Convention, the Embassy can provide consular services to Kenyans whenever they are detained by law enforcement authorities or denied entry to Cuba or transit through Cuba by immigration authorities.

In the event a Kenyan national is detained by law enforcement authorities or denied entry into the territory of Cuba, the authorities in Cuba will inform the Embassy. The Embassy will proceed to request access to the Kenyan in distress to provide consular services.

  1. Attempt to ensure that they receive a fair and speedy trial.
  2. Visit them in prison to ensure that they are receiving humane treatment.
  3. Converse and correspond with them and assist in arranging for legal representation.
  4. Facilitate communications with their families both in Kenya or any other part of the world.

We advise Kenyans in the Diaspora to ensure that they observe the laws and regulations of the country they are residing in or visiting in order to avoid getting into trouble with law enforcement authorities. We urge all Kenyans to keep their immigration status valid at all times and avoid being at the risk of facing deportation proceedings. All travel documents should in addition be kept valid. It is also important to register with the Embassy in case of any eventualities. If for any reason you are arrested and/or detained request to contact the Embassy. This way the Embassy will be able to notify the next of kin of the predicament of the Kenyan in order to find possible ways for assistance and also to provide any required consular assistance.
